The fight for the writer of the manuscript was carried out for many years.. Franz Kafka bequeathed his works to a close friend – Max Brod, that he destroyed them after his death. The beloved writer, Dora Diamant, unlike Brod, destroyed part of it is at the Kafka manuscripts, which he had left her. But Brod, time valuing literary contribution of other, did not obey the will of the writer, and took another part of the manuscripts with him to Palestine, where he fled from Prague from the Nazi persecution in 1939. That Brod organized a posthumous publication of many works of Kafka, despite the fact that the writer bequeathed “to destroy the manuscript, without reading it.” Among them -. Brought posthumous fame works Kafka “The Castle” and “process”
Brod died in Israel in 1968, all his own papers with the manuscripts of Kafka left his secretary Esther Hoffa. She had to “publish his work and see to it that after her death the literary status of Kafka was given to be deposited in an appropriate institution”, it said in court records. On Monday, the third and last time an Israeli court rejected a claim daughters and granddaughters Hoffa, who claimed that the archive is in their possession, as he bequeathed his secretary Wade. According to the daughter, the archive became vain Wade Hoffa, therefore rightfully theirs. However, even during the previous stages of the proceedings the court found that the manuscript can not be present, since the act of giving has not been covered. Moreover, as pointed out National Library in the first lawsuit, Brod bequeathed his secretary to transmit it to the paper as a gift to any public archives or library at the latest – right after her death
Attempts sale
<. p> but Hoffa not only handed over the documents as a gift, but even sold some papers from the archive, stored in two parts in cells banking in Zurich and Tel Aviv. Even in 1973, after it became known that Hoffa offered the manuscript of Kafka’s foreign auctions, Israel’s Attorney General warned her that “by the will of Wade, it should not dispose of any of the documents.” After the death of Hoffa in 2007 the heiress decided to sell another part of the manuscript, but this intention was challenged in the court of the Israeli National Library
